Merck Animal Health was recently hit with a Class Action lawsuit by pet owners who claim their beloved cat and dog drug, Bravecto, contains a dangerous pesticide. But the corporation would only settle with customers if she signed a contract that would release any legal claims against the corporation, according to the Bravecto Class Action lawsuit. While the manufacturer of Bravecto did not knowingly produce a dangerous chemical, they were nevertheless negligent in doing so. According to this Class Action lawsuit, Bravecto was sold to Merck Animal Health by an unscrupulous owner who failed to obtain a veterinarian’s prescription prior to selling the chemical to Merck.
When contacted by the plaintiffs, Merck denied manufacturing and distributing a dangerous chemical. Yet documents were later discovered in an internal employee computer that indicated this was indeed the case. Subsequent litigation exposed the dirty secret that many corporations must contend with when a plant or corporation engages in S.C. liability.
Merck eventually settled the lawsuit by agreeing to pay a $75 million dollar fine and admit their wrongdoing. However, the class-action lawsuit continues. The plaintiffs are asking for an additional $1.75 billion in compensatory and punitive damages. Additionally, they are requesting that the U.S. FDA require that all formulations of Bravecto be held in storage cabinets that lock out the air during processing and packaging. This is the only way that they will be able to ensure that the chemical is properly monitored and stored.
In regard to filing a lawsuit, you may want to look into the law firm of Jones Day. They have successfully handled mergers and acquisitions for both corporations and individual clients. If your Bravecto can be bought for a considerably lower price than the current market value, it will benefit the plaintiff to file a lawsuit so that he or she can recoup his losses.
